Terms of Service

By using TucsonSol Photography ("we," "our," or "us") services or accessing our website tucsonsol.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services or website.

Services

We provide professional photography services including but not limited to portrait sessions, pet photography, corporate event coverage, and landscape photography. All services are subject to availability and mutual agreement on scope, location, and schedule.

Booking & Payment

A signed agreement and 50% non-refundable booking fee are required to secure your session date. The remaining balance is due on or before the day of the photoshoot. We accept cash, credit cards, and online payments. Prices are subject to change, but quoted rates are honored for 30 days.

Cancellation & Refund Policy

Cancellations made at least 48 hours before the scheduled session may reschedule at no additional cost. Cancellations within 48 hours forfeit the booking fee. In the event of inclement weather or photographer illness, we will reschedule at no charge. Refunds are not issued for completed sessions, as digital products and services are non-returnable.

Photo Delivery & Turnaround

Portrait session galleries are delivered digitally within 2 weeks of the session date. Corporate event galleries are delivered within 3 weeks. Expedited delivery is available for an additional fee. Files are delivered via private online gallery and remain available for download for 90 days.

Intellectual Property & Usage Rights

All photographs and digital content created by TucsonSol Photography are the intellectual property of TucsonSol Photography. Upon full payment, clients receive a personal print release for non-commercial use. We retain the right to display photographs in our portfolio, website, social media, and marketing materials unless a written agreement specifies otherwise. Clients may not sell, license, or commercially use photographs without a separate written agreement.

Model Release

By booking a session with us, you grant TucsonSol Photography permission to use the resulting photographs for portfolio, website, social media, and marketing purposes. If you wish to restrict such use, you must notify us in writing prior to the session.

Client Responsibilities

Clients are responsible for arriving at the agreed location on time, providing accurate information, and obtaining necessary permissions for photography at private venues. We are not liable for delays caused by client tardiness.

Limitation of Liability

TucsonSol Photography's liability is limited to the total amount paid for services. We are not liable for any indirect, incidental, or consequential damages arising from the use of our services or website, including but not limited to loss of data, loss of revenue, or emotional distress. In the unlikely event of equipment failure or data loss, our liability is limited to a re-shoot of the affected portion of the session.

Website Use

You agree not to use our website for any unlawful purpose or in violation of these terms. You may not reproduce, distribute, modify, or create derivative works from our website content without our prior written consent.

Disclaimer of Warranties

Our website and services are provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Pima County, Arizona.

Dispute Resolution

In the event of a dispute, the parties agree to first attempt to resolve the matter informally by contacting us at TucsonSol2@gmail.com. If the dispute cannot be resolved within 30 days, either party may pursue arbitration or legal proceedings as permitted by law.

Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services or website after changes constitutes acceptance of the new terms.
